Abstract
Günümüzde en çok işlenen suçlardan biri de dolandırıcılık suçudur. Özellikle gelişen teknoloji de kullanılarak dolandırıcılık suçunun en çok bilişim sistemleri üzerinden işlendiği görülmektedir. Bu tez çalışmasında hileli eylem içeren dolandırıcılık suçu hakkında temel bilgiler verilerek, suçun bilişim sistemleri üzerinden işlenme yöntemleri, benzer suçlarla ilişkisi ve suçun önlenmesine ilişkin alınabilecek önlemler incelenmiştir. İlk bölümde; dolandırıcılık suçu hakkında temel bilgiler verilmiştir. Dolandırıcılık suçunun unsurlarından, hukuka uygunluk nedenlerinden, kusurluluk unsurundan ve dolandırıcılık suçuna ilişkin genel ceza hukuku alanında bilgilere yer verilmiştir. İkinci bölümde ise; çalışmamızın konusu da olan Türk Ceza Kanunu'nun 158/1-f maddesinde düzenlenen bilişim sistemlerinin banka veya kredi kurumlarının araç olarak kullanılması suretiyle dolandırıcılık suçuyla bağlantılı olan bilişim, bilişim sistemi, banka, kredi kurumları kavramları hakkında bilgiler verilerek söz edilen nitelikli dolandırıcılık suçunun işlenme yöntemleri, suçun önlenmesine ilişkin alınabilecek yöntemler ve bazı suçlarla ilişkisi farklı görüşler, örnekler ve yargı kararları ile incelenmiştir.
One of the most committed crimes today is the crime of fraud. Especially by using the developing technology, it is seen that the crime of fraud is mostly committed through information systems. In this thesis, by giving basic information about the crime of fraud involving fraudulent action, the methods of committing the crime through information systems, its relationship with similar crimes and the measures that can be taken to prevent the crime are examined. In the first part, basic information about the crime of fraud is given. Information on the elements of the crime of fraud, the reasons for compliance with the law, the element of culpability and the general criminal law on the crime of fraud are given. In the second part; information about the concepts of informatics, informatics system, bank, credit institutions, which are related to the crime of fraud by using information systems regulated in Article 158/1-f of the Turkish Criminal Code, which is also the subject of our study, as a means of using banks or credit institutions, and the methods of committing the mentioned qualified fraud crime, the methods that can be taken to prevent the crime and its relationship with some crimes are examined with different opinions, examples and judicial decisions.
