Abstract
Bu makale, hukuki ifadelerin semantiğini H.L.A. Hart ile Joseph Raz arasındaki teorik farklılıklar bağlamında ele almaktadır. Her iki düşünür de hukuki ifadelerin ampirik ifadelere indirgenemeyeceği görüşünde birleşir ve bu ifadelerin özünde deontik nitelikte olduğunu kabul eder. Bununla birlikte, hukuki ve ahlaki ifadelerin aynı anlama sahip olup olmadığı konusunda görüş ayrılığına düşerler. Hart, kariyeri boyunca hukuki ifadelerin ahlaki ifadelerden farklı, kendine özgü (sui generis) bir anlama sahip olduğunu savunmuştur. Buna karşılık, sert hukuki pozitivist olmasına rağmen Raz, hukuki ifadelerin anlam bakımından ahlaki ifadelerle aynı olduğunu ileri sürer. Bu tezi temellendirmek için Raz, hukuki söylemin fenomenolojik sorununu çözmeyi amaçlayan yansız ifadeler kavramını ortaya koyar. Hart açısından ise böyle bir sorun söz konusu değildir; zira hukuki ifadelerin anlamının ahlaki ifadelerden farklı olduğunu kabul etmek, onların özgül normatif karakterini zaten açıklamış olur. This article examines the semantics of legal statements in the context of the theoretical differences between H.L.A. Hart and Joseph Raz. Both thinkers agree that legal statements cannot be reduced to empirical ones and that such statements are essentially deontic in nature. However, they diverge on whether legal and moral statements share the same meaning. Throughout his career, Hart maintained that legal statements have a distinct, sui generis meaning, different from that of moral statements. Raz, by contrast-despite being a hard legal positivist-argues that legal statements have the same meaning as moral statements. To defend this position, Raz introduces the concept of detached statements, aiming to resolve the phenomenological problem of legal discourse. For Hart, such a problem does not arise, since accepting that legal statements have a meaning distinct from moral ones already accounts for their unique normative character. The article concludes that Hart’s account of the semantics of legal statements offers a more coherent and philosophically defensible position.
