Abstract
Sosyal güvenlik hakkı, temel hak ve özgürlükler içinde yer alan başlıca sosyal haklardan biridir. Sosyal güvenlik hakkının zaman içinde geçirmiş olduğu değişim, açık ve net bir şekilde ortaya konulduğu takdirde hakkın anlam, kapsam ve içeriğinin anlaşılması mümkündür. Sosyal güvenlik hakkının diğer insan hakları ve sosyal haklardan ayrıldığı görülmektedir. Çünkü sosyal güvenlik, temel bir insan hakkı olduğu gibi ayrıca devletlerin politikalarına doğrudan etki eden bir sistem olarak ortaya çıkmış bir haktır. Bu bakımdan sosyal güvenlik hakkının etkinleştirilmesi temelinde hakkın çok katmanlı yapısı ve dinamik niteliği gereği, günümüzde ulaşmış olduğu çerçeve ulusal ve uluslararası boyutuyla incelenmiştir. Sosyal güvenlik hakkının ulaştığı nokta, hakkın ortaya çıktığı ilk zamandan itibaren genişlemiş ve genişlemeye de devam etmektedir. Bu anlamda, sosyal güvenlik hakkına eklemlenen bireylere temel gelir sağlanması, eksiksiz tıbbi bakım, yoksulluk ve sosyal dışlanmaya karşı korunma hakkı bunlar arasında sayılabilir. Sosyal güvenlik hakkının normatif çerçevesini belirlemek kadar bu hakkın etkinleştirilmesi de bir o kadar önemlidir. Söz konusu amacın hayata geçirilmesinin en etkin ve etkili yapıldığı merci ise mahkemelerdir. Avrupa İnsan Hakları Mahkemesi'nin sosyal güvenlik hakkı ile ilgili zamanla değişen çizgide farklı ilkeler geliştirmek suretiyle hakkın etkinleştirilmesini sağlayacak pek çok kararı bulunmaktadır. Ayrıca ülkemizde Anayasa Mahkemesi'ne bireysel başvuru yolunun kabul edilmesi ile birlikte sosyal haklar içinde yer alan sosyal güvenlik hakkının bireysel başvuruya konu edilemeyeceği ön yargısının değişen yorum yöntemleri ile birlikte kırılması gerekmektedir. Sonuç olarak sosyal güvenlik hakkı ile ilgili asıl incelemesi gereken temel mesele, sosyal güvenlik hakkının daha etkin ve etkili kullanılmasının ne şekilde sağlanacağının belirlenmesi noktasında yoğunlaşmaktadır.
The right to social security is one of the main social rights within the fundamental rights. It is possible to understand the meaning, scope and content of the right if the change has been clearly and clearly in time revealed. It is seen that the right to social security differs from other human rights and social rights. Because social security is not only a fundamental right, but also a right that has emerged as a system that directly affects the policies of states. In this respect, due to its multi-layered structure and dynamic nature, the framework reached today based on the activation of the right to social security, has been examined with its national and international dimension. The point reached by the right to social security has expanded and continues to expand since the first time of the right. In this sense, the right to provide basic income, complete medical care, protection against poverty and social exclusion to individuals assessed within the right to social security may be counted among them. Enabling this right is as important as determining the normative framework of the right to social security. Courts are the authority where the realization of this is the most active and effective. The European Court of Human Rights (ECtHR) has signed decisions that will enable the right to be activated by developing different principles on the right to social security along varying lines over time. In addition, with the right to individual application to the Turkish Constitutional Court, although there is a prejudice that social rights cannot be subject to individual application, the issue of justiciability of the right to social security is a debate that has lost its validity with changing interpretation methods. As a result, the main issue to be examined on this point is focused on how to ensure the more effective use of the right to social security.
