Abstract
Bu çalışma, Türk idare hukukunda mobbing iddialarının ispatında tanık delilinin kritik rolünü ele almaktadır. Mobbing, kamu görevlileri üzerinde önemli olumsuz etkileri olan bir olgu olarak, idare hukuku çerçevesinde özel bir öneme sahiptir. Çalışmada mobbing kavramı ve bileşenleri detaylı bir şekilde incelenirken, bu olgunun idare hukuku ile ilişkisi ortaya konulmaktadır. Mobbing davalarında tanık ifadeleri, disiplin soruşturmaları ve yargılama süreçlerinde hakikatin açığa çıkarılması açısından hayati bir delil niteliği taşımaktadır. İdari yargıda tanık dinlenmesi yerleşik Danıştay kararları uyarınca mümkün olmamakla birlikte doktrinde aksi yönde görüşler de bulunmaktadır. Bununla birlikte, Danıştay’ın tanık dinlenmesine yönelik olumsuz görüşüne karşın, pratikte tanık deliline duyulan ihtiyaç, göz ardı edilemeyecek bir gerçeklik olarak ön plana çıkmaktadır.
This study examines the critical role of witness testimony in proving allegations of mobbing within Turkish administrative law. Mobbing, as a phenomenon with significant negative impacts on public officials, holds particular importance within the framework of administrative law. While the concept of mobbing and its components are analyzed in detail, the study also explores the relationship between this phenomenon and administrative law. Witness statements in mobbing cases serve as vital evidence, especially in disciplinary investigations and judicial proceedings, to uncover the truth. Although the hearing of witnesses in administrative courts is not permitted according to established rulings of the Council of State (Danıştay), there are opposing opinions within legal doctrine. Despite the Council of State’s negative stance on the admissibility of witness testimony, the practical necessity of relying on such evidence emerges as an undeniable reality.
