Anayasa Mahkemesi Kararlarını Biçimlendirme Çabası Olarak Yorum

Abstract

Yorum çok boyutlu bir fenomendir. Bu yüzden hukukta yorum müessesi öteden beri tartışılmaktadır. Ancak anayasal yorum hususunda Kıta Avrupa’sındaki çalışmalar, çoğunlukla İkinci Dünya Savaşı sonrasına denk gelmektedir. Gerçekten de bu dönemden sonra anayasa yorumunun mahiyetinin diğer hukuk metinlerinden farklı olduğu veya farklı olması gerektiği ortaya konulmuştur. Peki, anayasal yorumu diğer hukuksal uyuşmazlıklara nazaran özel yapan nedir? Özellikle bir anayasal demokraside anayasa yargıçları ne tür farklı yorum teknikleri kullanmaktadırlar? İşte çalışmamızda anayasanın bu çerçevede yorumlanması bahsini inceleyeceğiz. Bu doğrultuda biz aşağıda öncelikle yorum teorisini inceleyerek anayasal hermeneutiğe değineceğiz. Ardından anayasanın yorumlanmasını ve nihai olarak anayasaya özgü yorum yöntemlerini ele almaya çalışacağız.Interpretation is a multidimensional phenomenon. That is why the institution of interpretation in law has long been discussed. However, studies on constitutional interpretation in Continental Europe mostly coincide with the post-World War II period. Indeed, after this period, it has been revealed that the nature of the constitutional interpretation is different from other legal texts or should be different. So, what makes the constitutional interpretation special compared to other legal disputes? What different techniques of interpretation do constitutional judges use, especially in a constitutional democracy? In our study, we will examine the interpretation of the constitution in this framework. In this regard, we will first examine the theory of interpretation and touch upon constitutional hermeneutics. Then we will try to consider the interpretation of the constitution and ultimately the methods of interpretation specific to the constitution.
