Zorunlu Mecra Hakkının Dava Yoluyla Kurulması

Abstract

Türk Medeni Kanunu m.744’te hangi şartlarda kurulabileceği belirtilen zorunlu mecra hakkı, taşınmaz mülkiyetinin kısıtlamalarından birisi olmasının yanı sıra zorunlu ve kanuni bir irtifak hakkıdır. Zorunlu mecra hakkı irtifak söz-leşmesiyle kurulabileceği gibi dava yoluyla da kurulabilir. Zorunlu mecra hakkının taşınmaz mülkiyetini kısıtlamasıkonusunun incelenmesi ve hak sahibinin talep yetkisinin kapsamının belirlenmesi davanın türünün nitelendirilmesi için önemlidir. Çalışmamızda zorunlu mecra hakkının taşınmaz mülkiyetini kısıtlaması ve hakkı kurmaya yönelik talep yetkisinin hukuki niteliği belirlendikten sonra, zorunlu mecra hakkını kurmaya yönelik davanın türü belirlen-meye çalışılacaktır. Davanın türünün belirlenmesi neticesinde zorunlu mecra hakkının kurulduğu an tespit edilmişolacaktır. Türk Hukukunun yanı sıra İsviçre Hukukunda yer alan görüşler de çalışmamıza yön verecektirThe statutory transmission right of way, which is specified in art.744 of the Turkish Civil Code, is a statutory right of easement as well as being one of the restrictions of immovable property. This right can be established by easement agreement or by litigation. It is important to examine the issue of the statutory transmission right of way restricting the ownership of immovables and to determine the scope of the claim authority of the right holder for the characterization of the type of the case. In this article, after the review of the owner of the information about the restriction of immovable property and the statutory right of way for use in establishment, type of case will be tried to be determined for the establishment of transmission right of way. As a result of the determination of the type of the case, the moment when statutory transmission right of way is established will be determined. In addition to Turkish Law, the views in Swiss Law will also guide our work.
