Abstract
Osmanlı dönemi fıkıh ve lügat âlimlerinden Pîr Mehmed’e nispet edilen bir risâlede, İbnMelek’in Şerhu’l-Menâr’ındaki ‘emir’ bahsinden seçili kimi itirazların cevaplandırıldığı vebazı kabullerin eleştirildiği bir bölüm de bulunmaktadır. Bu bölüm muhtevasının tahliliyle, zikri geçen risâlenin fıkıh usulü edebiyatındaki önemine ve müellifinin usuldeki yetkinliğine dair kanaatleri belirleyecek veya etkileyecek birtakım verilere ulaşılabilmektedir.Bu çalışmanın amacı, söz konusu verilerin tespiti ve genel bir sonuca dönüştürülmesidir.Bu doğrultuda, risâledeki usul meselelerinin her biri müstakil biçimde ele alınmış, içerdikleri tartışmalara hazırlayıcı kısa tanıtımlar akabinde müellife ait izahların iç tutarlılığıirdelenmiştir. Hanefî usulünde yaygın görüşlere göre konumu belirlenmeye çalışılan buizahlar, Şerhu’l-Menâr ile Menârü’l-envâr’ın diğer bazı şerh ve hâşiyelerindeki bilgilerle demukayese edilmiştir. Risâlenin adı, aidiyeti, hedefi ve üslubu ile -inceleme alanı dışındakalan- bölümlerinin mahiyetine ilişkin bazı öneri ve notlar da içeren bu çalışmanın, müellifin ilmî kişiliği ve eserleri üzerine yapılacak kapsamlı ve derinlikli araştırmaların, kendialanıyla ilgili kısımlarına somut katkılar sunabileceği de öngörülmektedir
In a treatise attributed to Pīr Mehmed, one of the scholars of İslamic Jurisprudence and linguistics of the Ottoman period, there is a section in which some objections and assumptions, which are selected from a chapter titled as ‘order’ of Ibn Malak’s work called Šarḥ alManār, are answered and criticized. With the content analysis of this section, it is possible to underline the importance of aforementioned treatise in the literature of İslamic Jurisprudence and to reach some data which determine or influence the opinions about the competence of the author. The aim of this study is to identify these data and to transform them into a general conclusion. In this sense, each of the methodological discussions in the treatise is dealt with specifically, and the internal consistency of the author's explanations after the short introductions of these discussions is examined. These explanations, which are tried to be determined according to widespread views in Ḥanafī method, are also compared with the information in some other šarḥ and ḥāšiya written for the works, Šarḥ al-Manār and Manār al-anwār. It is also envisaged that this study, which includes not only the name, identity, and style of the treatise but also some suggestions and notes related to the content of the chapters that are outside the research area, may provide concrete contributions to the relevant parts of the comprehensive and in-depth research which is conducted on the author’s both scientific personality and his Works.
