Abstract

Çevrenin Kasten Kirletilmesi Suçu (TCK Madde 181) ve Kriminolojik Olarak İncelenmesi Bu çalışmada, çevrenin kasten kirletilmesi suçu Türk Ceza Kanunu'nun 181. maddesi kapsamında ele alınmış; çevre ceza hukukunun teorik temelleri ile uygulamadaki yansımaları bütüncül bir yaklaşımla incelenmiştir. Çalışmanın birinci bölümünde çevre hakkının tarihsel gelişimi, çevre hukukunun ortaya çıkışı ve çevrenin korunmasında cezai yaptırımların gerekliliği ele alınmış; bu kapsamda Çin, ABD, İsveç ve Almanya örnekleri incelenerek mukayeseli hukuk perspektifinden Türk çevre ceza hukukunun normatif yapısı değerlendirilmiştir. İkinci bölümde TCK m.181 hükmü ayrıntılı biçimde analiz edilerek suçun maddi ve manevi unsurları, fail ve mağdur kavramları ile birlikte suçun soyut tehlike suçu niteliği, çevreye yönelik risk oluşturma boyutu ve suçun özel görünüş biçimleri olan teşebbüs, iştirak ve içtima kurumları ele alınmıştır. Ayrıca Yargıtay içtihatları ışığında uygulamada ortaya çıkan sorunlar değerlendirilmiştir. Üçüncü bölümde ise yeşil kriminoloji yaklaşımı benimsenerek çevre suçlarının sosyolojik ve kriminolojik boyutları incelenmiş; çevre suçlarında mağduriyet kavramının yalnızca bireylerle sınırlı kalmayıp doğayı ve gelecek kuşakları da kapsayacak şekilde yeniden tanımlanması gerektiği sonucuna ulaşılmıştır. Çalışmanın sonucunda, çevre suçlarıyla etkin mücadelede yalnızca cezai yaptırımların yeterli olmadığı; çevre bilincinin artırılması ve kurumsal sorumluluğun güçlendirilmesinin de zorunlu olduğu vurgulanmıştır.
In this study, the crime of intentional pollution of the environment is examined within the scope of Article 181 of the Turkish Penal Code, and the theoretical foundations of environmental criminal law as well as its practical implications are analyzed through a holistic approach. In the first chapter, the historical development of the right to a healthy environment, the emergence of environmental law, and the necessity of criminal sanctions for environmental protection are discussed; within this framework, the normative structure of Turkish environmental criminal law is evaluated from a comparative law perspective through an examination of the legal systems of China, the United States, Sweden, and Germany. In the second chapter, Article 181 of the Turkish Penal Code is analyzed in detail, addressing the material and mental elements of the offense, the concepts of perpetrator and victim, the characterization of the crime as an abstract endangerment offense, the risk posed to the environment, and the special forms of appearance of the crime, including attempt, participation, and concurrence of offenses. In addition, problems encountered in practice are assessed in light of the case law of the Court of Cassation. In the third chapter, adopting a green criminology perspective, the sociological and criminological dimensions of environmental crimes are examined, leading to the conclusion that the concept of victimization should be redefined to encompass not only individuals but also nature and future generations. As a result, the study emphasizes that effective combat against environmental crimes requires not only criminal sanctions but also the strengthening of environmental awareness and institutional responsibility.
