Abstract

Öz: Tarihi süreç içerisinde mağdur kavramının kimi zaman unutulduğu, unutulmasa bile geri plana itildiği, kimi zaman da hatırlanarak ön plana çıktığı bilinmektedir. 20. yüzyılın ortalarından bu yana fail odaklı ceza hukuku anlayışından mağdur odaklı ceza hukuku anlayışına doğru bir paradigma değişimi olmuştur. Dikkatlerin mağdur, mağdur hakları, mağdurun ihtiyaçları ve mağduriyetin giderilmesi kavramlarına yönelmesiyle birlikte, multidisipliner ve uluslararası çalışmalar şekillenmiş, onlar da ceza adalet sistemlerini şekillendirmiştir. Ancak söz konusu süreç, halen gelişimini devam ettirmektedir. Bu durum, hukuk sistemimiz için de geçerlidir. Ceza adaleti sistemimiz hem anayasadaki hem de ceza hukuku mevzuatındaki düzenlemelerle mağdurun korunması noktasındaki gelişimini sürdürmekte ve eksiklerine rağmen uluslararası standartlarda bir koruma sağlamaya çalışmaktadır. Uluslararası belgelerde belirlenen asgari standartların üzerine çıkmak, ülkelerin mağdurlara verdiği önemin bir göstergesini oluşturacaktır. Uluslararası örnekler, kendi şartları doğrultusunda genellikle şiddet suçu mağdurlarına farklı sistemler oluşturarak çözüm üretmeye çalışmaktadırlar. Bütüncül bir bakış açısıyla mağdurun zararının giderilmesi ve manevi açıdan desteklenmesi gibi tüm ihtiyaçları, mağduriyetin gerek dolaylı olarak ceza ve ceza muhakemesi kurumlarıyla gerekse de doğrudan fail veya devlet tarafından giderilmesi yoluyla karşılanmaktadır. Ülkemiz bakımından sosyal bir hukuk devleti de olmanın gereği ve sonucu olarak, mağdurlar için daha koruyucu bir sistem inşa etmenin mümkün olup olmadığı irdelenmelidir.
Abstract: It is known that in the historical process, the concept of the victim is sometimes forgotten, even if it is not forgotten, it is pushed to the background, and sometimes it is remembered and brought to the forefront. Since the mid-20th century, there has been a paradigm shift from a perpetrator-oriented criminal law approach to a victim-oriented criminal law approach. As the attention has shifted towards the concepts of the victim, victim rights, victim’s needs and redressing victimisation, multidisciplinary and international studies have been shaped and these studies have shaped the criminal justice systems. However, the process in question still continues to develop. This situation is also valid for our legal system. Our criminal justice system continues its development in terms of victim protection with the regulations in both the constitution and the criminal law legislation and tries to provide protection at international standarts despite its shortcomings. Exceeding the minimum standarts set out in international documents will constitute an indicator of the importance that countries attach to victims. International examples, in line with their own conditions, generally try to produce solutions for victims of violent crimes by creating different systems. From a holistic perspective, all the needs of the victim, such as compensation for damages and moral support, are met either indirectly through criminal and criminal procedure institutions or directly by the perpetrator or the state. As a necessity and consequence of being a social state of law in our country, it should be examined whether it is possible to build a more protective system for victims.
