2017 Anayasa Değişikliğinin Demokratik Nitelik Sorunu

Abstract

Bu çalışma 2017 Anayasa değişikliğinin kuruculuk vasfını demokratik perspektifle sorgulamaktadır. 2017 Anayasa değişikliği her şeyden önce bir kurucu iktidar tekniği ortaya koymaktadır. Şu hâlde bu Anayasa değişikliğinin kuruculuk vasfının sorgulanması gerekir. Bu çalışmada vardığımız sonuç 2017 Anayasa değişikliğini öngören kurucu iktidarın gerek oluşumu, gerek işleyişi bakımından pek çok soruna işaret ettiğidir. Bu sorunlardan en önemlisi demokratik meşruluk meselesidir. İşte çalışmada bu doğrultuda demokratik kurucu iktidarın vasfı incelenerek demokrasi ve hukuk devleti ile ilişkisi ele alınmıştır. Ardından 2017 Anayasa değişikliğinin özellikleri ve demokratik mahiyeti tartışılmıştır. Tüm bunlar dikkate alınarak sonuç bölümünde bir değerlendirme yapılmış ve öneriler sunulmaya çalışılmıştır.This study questions the founding nature of the 2017 Constitutional amendment from a democratic perspective. The 2017 Constitutional amendment first of all reveals a constituent power technique. Therefore, the founding nature of this constitutional amendment should be questioned. The conclusion we have reached in this study is that the constituent power, which envisions the 2017 Constitutional amendment, points to many problems in terms of both its formation and functioning. The most important of these problems is the issue of democratic legitimacy. Here, in this direction, the qualification of the democratic founding power has been examined and its relationship with democracy and the rule of law is discussed. Then, the features and democratic nature of the 2017 Constitutional amendment were discussed. Taking all these into consideration, an evaluation has been made in the conclusion section and recommendations have been tried to be presented.
