Abstract
Yasa gücünde kararname yetkisinin bir başkanlık rejiminin politika oluşturma süreci üzerindeki etkisi nedir? Bu soruyu yanıtlamaya yönelik çabalara rağmen, literatürde kararname yetkilerinin cumhurbaşkanının yasama sürecini kontrol etmesine ne ölçüde izin verebileceği konusunda hala çok fazla belirsizlik var. Bu çalışma, bir sert güçler ayrılığı sisteminde, kararname varlığının, yöneticilerin gündem belirleyici olarak hareket etme yeteneklerini etkili bir şekilde geliştirdiğini ortaya koymaktadır. Bu doğrultuda aşağıda öncelikle başkanlık sisteminin genel özellikleri ve kararname kavramı ortaya konulacaktır. Ardından, karşılaştırmalı başkanlık sistemlerinde yasa gücünde kararname yetkisinin konumu ve etkileri tespit edilmeye çalışılacaktır. Nihayet, Cumhurbaşkanlığı Hükümet Sisteminde yer alan Cumhurbaşkanlığı Kararnamesi değerlendirmeye tabi tutulacaktır.
What effect does the power of constitutional decree have on the policy- making process of a presidential regime? Despite recent efforts to answer this question, there is still much uncertainty in the literature about the extent to which decree powers can allow the president to control the legislative process. This study reveals that in a strict separation of powers system, the presence of decree effectively improves the ability of administrators to act as agenda-setter. In this direction, first of all, the general characteristics of the presidential system and the concept of decree will be revealed. Then, the position and effects of the legislative power in the comparative presidential systems will be tried to be determined. Finally, the Presidential Decree in the Presidential Government System will be evaluated.
