Abstract
Kaliforniya eyaletindeki yasal mal rejimi olan mal ortaklığı rejimine göre evlenmeden önce eşlerin sahip olduğu iş yeri, o eşin ayrı malı sayılmaktadır. Evlilik süresince eşlerin emekleri karşılığı edindikleri mallar ise ortaklık malı sayılmaktadır. Eşlerden birinin, ayrı mal varlığına dahil iş yerinde evlendikten sonra da çalışması iş yerinin değerini artırabilir. Kaliforniya hukukunda eşlerin ayrı mal varlığına ait olan iş yerinin değerindeki artış Pereira ve Van Camp öğretilerine göre eşler arasında paylaştırılmaktadır. Kaliforniya Mahkemeleri malların tasfiyesinde hangi doktrini uygulayacaklarına iş yerindeki değer artışının ana sebebinin eşlerin koydukları sermayenin mi yoksa emeğin mi olduğunu dikkate alarak belirlemektedir. Bu çalışmada Kaliforniya mal ortaklığı rejimi ile benzer hükümler içeren, Türk mal rejimleri içerisinde seçimlik mal rejimi olarak düzenlenen mal ortaklığı rejimindeki emek ile gerçekleşen değer artış payı konusu da kısaca özetlenmiştir. Çalışmanın Türk hukukundaki uygulaması çok az olan mal ortaklığı rejiminde değer artış payı hesaplamasına farklı bir bakış açısı getirmesi ve uygulama örneği olması amaçlanmıştır.
According to the community property regime which is the legal property regime in the state of California, the business owned by the spouses before marriage is considered as the separate property of that spouse. The property acquired by the spouses in return for their labor during the marriage is considered community property. If a spouse continues to work at his own business after the marriage, the business value may increase. There are two approaches called Pereira and Van Camp to allocate the increase in the business. The California Courts determines which approach to apply in the liquidation of goods, considering whether the main reason for the increase in value in the business is the capital or labor of the spouses. In this study, Turkish property community property regime which contains similar provisions with the California community property regime, is also briefly examined. The aim of the study is to bring a different perspective to calculation of value increase share in community property, which has a few or non-applications under Turkish law.
