Türkiye’de Üniversite Genel Sekreterlik Kurumunun Hukuki Arka Planı ve Uygulaması

Abstract

The administrative organization is of great impor- tance for maintaining the academic activities of universities in a wholesomely and uninterrupted manner. This is because the admin- istrative organization encompasses many areas of activity, from stu- dent affairs, information processing, library and documentation to administrative and financial matters. Since these activities are sepa- rate disciplines, the legislature has preferred to separate administra- tive services from academic activities and present them in a sepa- rate structure. In this context, the subject of this study is the “Gen- eral Secretariat”, which is the head of the administrative organiza- tion of the college, and the “Secretary General”, who is responsible to the Rector for the activities of this organization. Although the administrative organization of universities is located at the intersec- tion of administrative law, public administration and higher educa- tion administration, it has not yet been sufficiently investigated as a subject of research in academia. This study therefore first examines the historical development and legal basis of the office of the Gen- eral Secretariat, then the current practice of the Secretary General’s office and finally the profiles of the Secretaries General working at state universities from March 2024.Üniversitelerin akademik faaliyetlerinin sağlıklı ve kesin- tisiz bir şekilde sürdürülebilmesinde idari örgütlenme oldukça önem taşımaktadır. Zira idari örgütlenme; öğrenci işlerinden bilgi işleme, kütüphane ve dokümantasyondan idari ve mali işlere kadar birçok faaliyet alanını içermektedir. Söz konusu faaliyetlerin ayrı birer uz- manlık alanı olmasından ötürü kanun koyucu, idari hizmetleri, aka- demik faaliyetlerden ayırarak ayrı bir yapı içerisinde sunmayı tercih etmiştir. Bu bağlamda çalışmanın konusunu üniversitenin idari ör- gütlenmesinin zirve makamı olan “genel sekreterlik” ve bu örgütün faaliyetlerinden rektöre karşı sorumlu olan “genel sekreter” oluş- turmaktadır. Üniversitelerin idari örgütlenmesi; idare hukuku, kamu yönetimi ve yükseköğretim yönetimi alanlarının kesişiminde yer almasına rağmen akademik çalışmalarda araştırma nesnesi olarak yeterince incelenmemiştir. Buradan hareketle çalışmada ilk olarak genel sekreterlik makamının tarihsel gelişimi ve hukuki dayanakla- rına, ardından mevcut genel sekreterlik uygulamasına ve son olarak ise 2024 yılı Mart ayı itibarıyla devlet üniversitelerinde görev yapan genel sekreterlerin profillerine ilişkin verilere yer verilmektedir.
