Abstract
Birleşik Devletler’de liyakat açısından temel ilkeleri belirleyen Kamu Personeli Reform Yasası, federal iş gücü istihdamını ve federal çalışanları aşırı partizan politikalardan korumak ve federal kamu personel sisteminin bütünlüğünü idame ettirmek adına; federal hükümete nitelikli, yetkin, ve siyasi olarak tarafsız bir iş gücü sağlamaya yönelik standartları ve düzenlemeleri kapsar. Yasa, federal kamu personel rejiminin önemli bir unsuru olan liyakat sistem ilkeleri dahilinde, federal iş gücü istihdamı yönetimine ilişkin temel prensipleri içerir. Bu çalışma öncelikle, Türk kamu personel rejiminin hukuki düzlemde kabul etmiş olduğu liyakat ilkesinin mevcut tartışmalı uygulanabilirliğinin, başkanlık sisteminin kabulü ile yoğunlaşan siyasi patronaj ilişkileri neticesinde tehlikede olduğu düşüncesi ile, ilkenin değerini ve gerekliliklerini daha iyi anlamak adına, benzer tehlikeleri bertaraf etmek amacıyla kabul edilen Birleşik Devletler Kamu Personeli Yasası’nda düzenlenmiş olan güncel liyakat sistem ilkelerinin incelenmesini içerir. Çalışma kapsamında ayrıca, Türkiye’de liyakat ilkesinin etkin bir şekilde uygulanması açısından önem arz eden bazı durumlar, Amerikan liyakat sistem ilkeleri göz önünde bulundurularak değerlendirilmiş ve daha etkin bir liyakat sistemi oluşturulmasına yönelik görüş ve önerilerde bulunulmuştur.
The Civil Service Reform Act, which defines the core principles of merit in the United States, sets standards and regulations aimed at providing the federal government with a qualified, competent, and politically neutral workforce in order to protect the federal workforce and federal employees from excessive partisan politics and to maintain the integrity of the federal civil service system. The law includes the fundamental principles of federal workforce recruitment management within the framework of the merit system, which is a key component of the federal public personnel regime. This study primarily examines the current merit system principles regulated in the United States Civil Service Reform Act, which was adopted to eliminate similar risks, in order to better understand the value and necessity of the principle, with the idea that the current controversial applicability of the merit principle accepted by the Turkish public personnel regime at the legal level is in danger due to the political patronage relations intensified with the adoption of the presidential system. Additionally, the study evaluates the key factors for the effective implementation of the merit principle in Turkey, considering American merit system principles, and offers opinions and recommendations for establishing a more effective merit system.
