Abstract
Yeryüzünün önemli bir kısmını kaplayan deniz alanları canlı ve cansız kaynaklar bakımından da devletlerin ilgisini çekmektedir. Bu kapsamda devletlerin, deniz alanlarından teknolojik ve hukuki şartların elverdiği ölçüde daha çok ve daha farklı biçimlerde faydalanma ihtiyacı ve isteği yapay adaların ve tesislerin her geçen gün sayısının artmasına zemin hazırlamaktadır. Günümüzde yerleşim, rekreasyon alanı, bilimsel araştırma, iletişim, doğal kaynakların işletilmesi gibi birçok alanda yapay ada ve tesislerin kurulduğuna şahit olmaktayız. Çeşitli amaçlarla kurulan bu yapıların hukuki uyuşmazlıklara konu olabilecek sorunları da beraberinde getirmesi muhtemeldir. Yapay adalar ve tesislerin kurulması, işletilmesi ve ortadan kaldırılmasıyla ilgili olarak uluslararası belgelerde devletlere birtakım hak ve yetkilerin yanında yükümlülükler de getirilmiştir. Devletlere tanınan hak ve yetkiler ile getirilen yükümlülükler ise 1982 BMDHS' de belirtilen deniz alanlarında farklılık göstermektedir. Bununla birlikte yapay adaların ve tesislerin kurulması, işletilmesi ve ortadan kaldırılması süreçlerinden kaynaklı deniz çevresinin kirlenmesiyle ilgili küresel ve bölgesel düzeyde düzenlenen uluslararası antlaşmalarda hükümler yer almaktadır. Fakat herhangi bir uyuşmazlık durumunda uygulanacak hukukun belirlenmesi bağlamında herhangi bir uluslararası antlaşmada bu kavramların tanımının yapılmamış olması sorun oluşturmaktadır. Bu çalışmada yapay adaların ve tesislerin uluslararası hukuk belgelerinde ele alınış biçimleri uluslararası hukuk perspektifinden irdelenmiş ve hukuki tanımına ilişkin birtakım öneriler getirilmeye çalışılmıştır.
The marine spaces which cover the significant part of the World attracts the attention of the states in terms of living and the other resources. In this sense, the need and desire of the states from benefiting the marine spaces differently and more and the extent to which the technological and legal conditions make possible, creates a ground of the increase of the number of the artifical islands and installations. Today, we have been witnessing the establishment of installations and the artificial islands in many areas like settlement, recreation area, scientific research, communication, resource management. It is possible that the structures which were established for various purposes will bring together the topics which will be issued in legal disputes. In addition to various rights and capacity given to the states in the international documents about the establishment and operation of the artificial islands and installations, the obligations were also brought. The rights, capacities and the obligations given to the states differ from the mentinoned marine spaces of 1982 UNCLOS. Besides, there are provisions in the global and local scale international treaties about the contamination of the marine environment due to the establishment, operation and decommissioning of the artifical islands and the installations. Yet in case of any dispute, determination of the law that will implement poses a problem because of not defininig this concept in the international treaties. In this study, handling forms of the artificial islands and installations in the international law treaties has been examined from a legal perspective and a handful of suggestion will be given about its legal definition.
