Abstract
Aile konutu müessesesi 4721 Sayılı Türk Medeni Kanunu’nun (TMK) yürürlüğe girmesiyle birlikte, Türk hukukunda uygulama alanı bulmuştur. Ailenin ortak yaşam alanının merkezi olarak kabul edilen aile konutu konusunda mehaz İsviçre Medeni Kanunu’nun (ZGB) aksine; Türk Medeni Kanununda şerh imkânı bulunmaktadır. Şerhin etkisi konusunda doktrinde ve yargı kararlarında oldukça tartışmalı hususlar söz konusudur. Çalışmamızda, özellikle aile konutu şerhi bulunmayan durumlarda iyiniyetli üçüncü kişinin TMK m.1023 kapsamında hak kazanımının korunup korunmayacağı ve tapu sicilinde işlem yapma konusunda şerhin etkisi konularında doktrindeki görüşler incelenmiş; geçmişten günümüze yargı kararlarında bu konuda verilen kararlar değerlendirilmiştir.
The legal concept of family home became applicable in Turkish law with the entry into force of the Turkish Civil Code No. 4721 (TCC). Unlike the Swiss Civil Code (ZGB), which serves as its source, the Turkish Civil Code allows for the registration of an annotation regarding the family home, which is recognized as the center of the common living space of the family. The legal effect of this annotation has been the subject of considerable debate in both the doctrine and judicial decisions. In our study, particular attention is given to whether the acquisition of rights by a third party acting in good faith is protected under Article 1023 of the Turkish Civil Code in cases where no annotation exists, and to the impact of the annotation on transactions within the land registry, while also analyzing judicial decisions on the matter from past to present.
