Abstract

Ulusalüstü insan hakları hukukunda Avrupa, Amerika ve Afrika'da yer alan bölgesel sistemlerin insan haklarının geliştirilmesi, korunması ve tanıtılmasına yönelik faaliyetleri bulunmaktadır. Bölgesel insan hakları sistemleri özellikle insan haklarının korunmasına yönelik denetim aracı olarak şikayet başvurusu usulünü geliştirmişlerdir. Şikayet başvurusu usulü her bir bölgesel sistemin kendi içinde oluşturduğu denetim organları tarafından gerçekleştirilmektedir. Avrupa sisteminde Avrupa İnsan Hakları Mahkemesi, Amerikan sisteminde Amerikan İnsan Hakları Mahkemesi ile Amerikan İnsan Hakları Komisyonu, Afrika sisteminde ise Afrika İnsan ve Halkların Hakları Komisyonu ile Afrika İnsan ve Halkları Hakları Mahkemesi şikayet başvurusu usulünü işleterek kendi bölgelerinde insan haklarının korunmasını sağlamaktadır. Bahsedilen denetim organlarının süreç içerisinde birbirinden etkilendiğini ve şikayet başvurusunun değerlendirilmesi usulüne ilişkin düzenlemelerin de buna göre şekillendiğini belirtmek gerekmektedir. Ancak her bir bölgesel sistemin kendi içinde dinamikleri farklılık göstermektedir. Dolayısıyla bölgesel insan hakları sistemleri, devletlerarası ve bireysel şikayet başvurusu usulünü uygulamak suretiyle ortak bir tutum sergileseler de her birinin usule ilişkin getirdikleri normlar bazı noktalarda farklılık arz etmektedir. İşbu çalışmada bölgesel insan hakları denetim organlarının devletlerarası ve bireysel başvurular ekseninde uyguladıkları usuller normatif eksende ayrıntılı bir şekilde değerlendirilmiş, gerekli noktalarda karşılaştırmalar yapılmış ve tespit edilen farklılıklar bütüncül bir bakış açısıyla ortaya koyulmaya çalışılmıştır.
In supranational human rights law, regional systems in Europe, America and Africa have activities for the development, protection and promotion of human rights. Regional human rights systems have developed the complaint procedure as a supervisory tool, particularly for the protection of human rights. The complaint application procedure is carried out by the supervisory bodies established by each regional system. In the European system, the European Court of Human Rights, the American Court of Human Rights and the American Commission of Human Rights in the American system, and in the African system, the African Commission of Human and Peoples' Rights and the African Court of Human and Peoples' Rights operate the complaint application procedure to ensure the protection of human rights in their own regions. It should be noted that the said supervisory bodies were influenced by each other in the process and the regulations regarding the evaluation procedure of the complaint application were shaped accordingly. However, the dynamics of each regional system differ in itself. Therefore, although regional human rights systems exhibit a common attitude by applying the interstate and individual complaint application procedure, the procedural norms brought by each of them differ in some points. In this study, the procedures applied by regional human rights inspection bodies on the axis of interstate and individual applications were evaluated in detail on the normative axis, comparisons were made at necessary points and the differences identified were tried to be revealed from a holistic perspective.
