Abstract

Tarih boyunca uğradığı birçok değişikliğe rağmen gıda hukuku, insanlığa sürekli hizmet eden bir hukuk dalı olmuştur. Sağlıklı ve güvenli gıdaya ulaşmak insanlığın temel problemlerinden biridir. Eski çağlardan beri halkın sağlıklı, kaliteli, tehlikesiz ve aldatmacadan uzak gıda ürünlerine ulaşmasının sağlanmasına yönelik düzenlemeler yapılmıştır. Gıda maddeleri güvenilir ve sağlık koşullarına uygun olmalıdır. Gıdaların işleme, üretim, dağıtım ve tüketim sürecinde meydana gelen köklü değişmeler, ne yediğini bilme hakkı olan tüketicinin, tükettiği gıda maddelerinden emin olamaması sonucunu doğurmuştur. Küresel çapta gıda ürünlerinde başvurulan hile ve aldatıcı uygulamalar insan sağlığını ve gıda güvenliğini tehlikeye atan bir meseledir. Günümüzde bazı üreticiler tüketicilerin dikkatsizliğinden faydalanmakta ve ekonomik kazanç sağlamak, üretim maliyetini düşürmek, bilinen bir markaymış algısı yaratmak gibi amaçlarla gıda ürünlerinde hileli uygulamalara başvurmaktadır. Ayrıca gıda ürünlerinin taklidi yoluyla meyve şurubunun üzüm pekmezi olarak pazarlanması, bitkisel kökenli yağların aromalarla ve katkı maddeleri ile tereyağına benzetilerek satılması gibi birçok aldatıcı uygulamalara başvurulmaktadır. Gıda ürünlerinde başvurulan hileli uygulamalar, insan sağlığını tehlikeye düşürmekte ve başta kanser olmak üzere pek çok hastalığa sebebiyet verebilmektedir. Dolayısıyla gıda güvenliği kamu sağlığı ile yakından ilişkili bir kavramdır. Bu çalışmanın amacı her geçen gün artarak devam eden ve sıklıkla gıdada tağşiş ve taklit şeklinde ortaya çıkan hileli uygulamalara dikkat çekerek farkındalığı arttırmak, Türk hukukundaki gıda hakkı ve gıda güvenliğine yönelik düzenlemeleri incelemek, Türk Ceza Kanunu'nda düzenlenen zehirli madde katma suçunu ayrıntısıyla ele alarak benzer suç ve kabahatlerle karşılaştırmasını yapmak, tağşiş/taklit eylemlerinin zehirli madde katma suçu ile ilişkisini araştırmak ve gıdada sahtekârlık probleminin çözülmesine katkıda bulunmaktır.
Despite the many changes it has undergone throughout history, food law has been a branch of law that constantly serves humanity. Access to healthy and safe food is one of the main problems of humanity. Since ancient times, regulations have been made to ensure that the public has access to healthy, high quality, non-hazardous and deception-free food products. Foodstuffs must be safe and suitable for health conditions. Fundamental changes in food processing, production, distribution and consumption processes have resulted in the consumer, who has the right to know what he/she eats, not being sure of the foodstuffs he/she consumes. Globally, cheating and deceptive practices in food products are an issue that endanger human health and the safety of food. Today, some manufacturers benefit from the carelessness of consumers and resorts to fraudulent practices in food products for purposes such as provide economic gain, reduce production costs, create the perception of being a known brand. In addition, many deceptive practices are resorted to such as marketing of fruit syrup as grape molasses or selling vegetablebased oil with flavorings and additives by analogy with butter through imitation of food products. These fraudulent practices in food products endanger human health and can cause many diseases, especially cancer. Therefore, food safety is a concept closely related to public health. The aim of this study is to raise awareness by drawing more attention to fraudulent practices that continue to increase day by day and frequently occur in the form of adulteration and imitation in food, to examine the regulations on the right to food and food safety in Turkish Law, to examine in detail the crime of adding poisonous substances regulated in the Turkish Penal Code, to investigate the relationship between adulteration/imitation acts and the crime of adding poisonous substances and misdemeanors and contribute to the solution of the food fraud problem.
