Abstract

Somut norm denetiminde bir anayasaya aykırılık iddiası Anayasa Mahkemesinin önüne ancak bakılmakta olan bir dava aracılığıyla getirilebilmektedir. Çalışmada bakılmakta olan dava şartı Anayasa Mahkemesi kararları ışığında çeşitli yönlerden incelenmeye çalışılmıştır. Bu kapsamda ilk olarak Anayasa Mahkemesinin önüne gelen itiraz başvurusunda şartın var olup olmadığını denetleme yetkisi tartışılmıştır. Ardından dava kavramının çeşitli usul kanunlarındaki ve anayasa yargısındaki kapsamları karşılaştırılmıştır. Davanın bakılmakta olması şartı, görev meselesi ve davanın yöntemine uygun olarak açılmış olması gerekliliği üzerinden incelenmiştir. Son kısımda ise bakılmakta olan dava şartının norm denetimi sürecinde ne zamana kadar aranacağına ve davanın sona erme hallerine değinilmiştir. Anayasa Mahkemesinin konuya ilişkin kararları incelendiğinde 2000’li yıllara kadar bakılmakta olan dava şartı konusunda hassas davrandığı göze çarpmaktadır. Kuruluşunun ilk yıllarında bakılmakta olan dava şartına ilişkin denetim yetkisini çekingen ve sınırlı bir şekilde kullanırken ilerleyen yıllarda katı, dar ve daha müdahaleci bir yorum anlayışı benimsemiştir. Günümüzde ise görev meselesi ve davanın sona ermesi hali dışında önüne gelen itiraz başvurularında bakılmakta olan dava konusuna müdahale etmediği görülmektedir. Nitekim çalışmada da Anayasa Mahkemesinin ilk bakışta belli olan açık ve net bir sorun olmadıkça dava mahkemesinin bakılmakta olan davanın varlığına ilişkin tespitine müdahale etmemesi gerektiği vurgulanmıştır.
In the context of concrete review of norms, an allegation of unconstitutionality may only be brought before the Constitutional Court through a pending case. This study attempts to examine the requirement of a pending case from various angles in the light of Constitutional Court decisions. In this context, the first point of discussion concerns the Constitutional Court’s authority to review whether this requirement is met in an objection application submitted to it. Subsequently, the scope of the concept of “case” in various procedural laws and in constitutional jurisprudence was compared. The condition that the case must be pending has been examined in terms of the issue of jurisdiction and the requirement that the case must have been brought in accordance with the proper procedure. In the final section, the paper addresses the question of how long the condition of a pending case must be sought during the judicial review process and the circumstances under which a case is deemed to have concluded. When the Constitutional Court’s decisions on the subject are analyzed, it is observed that the Court acted sensitively regarding the requirement of a pending case until the 2000s. While it exercised its review authority over this requirement in a hesitant and limited manner during its early years, it adopted a rigid, narrow, and more interventionist approach in subsequent years. Today, it is observed that the Constitutional Court does not interfere with the issue of a pending case in objection applications, except for matters of jurisdiction and the termination of the case. Indeed, the study also emphasizes that the Constitutional Court should not interfere with the determination of the case court regarding the existence of the case under consideration, unless there is a clear and obvious problem at first glance.
