Kara Ulaşım Aracının Engellenmesi, Alıkonulması ve Kaçırılması Suçu (TCK m.223/1)

Abstract

Bu çalışma, TCK’nın 223’üncü maddesinin 1’inci fıkrasında yer alan “Kara ulaşım aracının engellenmesi, alıkonulması ve kaçırılması suçu” olarak ifade edebileceğimiz suçu konu edinmektedir. TCK’nın “Ulaşım araçlarının kaçırılması ve alıkonulması” başlıklı 223’üncü maddesinde suçun konusu oluşturan ulaşım aracı dikkate alınarak birden fazla suç tanımına yer verilmiş bulunmaktadır. Maddenin 1’inci fıkrasında ise cebir, tehdit veya sair hukuka aykırı bir davranışla kara ulaşım aracının hareket etmesinin engellenmesi, durdurulması ve başka yere götürülmesi yaptırım altına alınmıştır. Bu çalışmada 223’üncü maddede yer verilen diğer suç tipleri ayrıca ele alınmamış, inceleme konusu, kara ulaşım aracının engellenmesi, alıkonulması ve kaçırılması suçu (TCK. m.223/1) ile sınırlandırılmıştır. İncelemeye konu bu suç tipi, temel hatlarıyla, suç tipi inceleme sistematiğine uygun olarak değerlendirilmiş ve açıklamalar sırasında ilgili yerlerde Yargıtay kararlarından örnekler verilerek konu izah edilmeye çalışılmıştır. Çalışmada, söz konusu suç tipi bağlamında karşılaşılabilecek sorunlu noktalar doktrindeki görüşler ve yargı kararlarının incelenmesi yoluyla ortaya konularak, bu sorunlara yönelik çözüm önerilerinin geliştirilmesi amaçlanmaktadır.This study focuses on the crime we can define as the “Obstruction, Detention, and Abduction of a Land Transport Vehicle”, as stipulated in Article 223, paragraph 1 of the Turkish Penal Code (TPC). Article 223 of the TPC, titled “Abduction and Detention of Transport Vehicles,” includes multiple crime definitions, taking into account the type of transport vehicle that constitutes the subject matter of the offense. Paragraph 1 of this article specifically penalizes the obstruction, stopping, or taking of a land transport vehicle to another location by force, threat, or other unlawful conduct. In this study, other crime types specified in Article 223 have not been separately addressed; the scope of the examination is limited to the crime of obstruction, detention, and abduction of a land transport vehicle (TPC art.223/1). This crime type, which is the subject of the study, has been evaluated in its basic outlines in accordance with the systematic approach to crime type analysis, and the subject has been elucidated by providing examples from Supreme Court decisions where relevant during the explanations. The study aims to identify problematic issues within the context of the mentioned crime type by examining doctrinal views and court decisions, and to develop solutions for these issues.
